Terms of Use
Finito is free software for making records. These terms are deliberately short and say what you would hope they say: use it for anything, keep your music, expect no guarantees.
The short version. Finito is free. Use it for anything, including commercial work, and keep every right to the music you make with it. It comes with no warranty, and the masters you approve are your responsibility.
1. Agreement
These terms cover your use of the Finito application and the finitomusic.com website ("Finito"). Installing or using Finito means you accept them. If you do not, do not install it.
Finito is made and distributed by Frankie Finito ("I", "me").
2. Licence
Finito is provided free of charge. You are granted a perpetual, worldwide, non-exclusive licence to install and use it on any Mac you own or control, for any purpose, personal or commercial.
There is no fee, no subscription, no licence key, and no seat limit. Voluntary contributions through the "Buy me a coffee" link are gifts. They buy no additional rights, no support commitment, and no guarantee of future development.
What you may not do
- Sell, rent, sub-licence, or redistribute Finito, whether alone or bundled with something else, without my written permission.
- Present Finito as your own product, or remove or alter its name, branding, or attribution.
- Reverse engineer, decompile, or disassemble the application, except where that restriction is void under law that applies to you.
- Circumvent or disable the signature verification that protects Finito's updates.
Passing along the unmodified installer, or linking to finitomusic.com, is welcome and needs no permission.
3. Your music is yours
I claim no ownership of, and no rights in, anything you make with Finito. Your recordings, your masters, and your exported files are entirely yours. Nothing in these terms gives me a licence to your audio, and the application transmits none of it to me. See the privacy policy.
You are responsible for holding the rights to the audio you process. Do not use Finito on material you are not entitled to use.
4. Open-source components
Finito incorporates open-source software, including the Sparkle update framework, NumPy, SciPy, libsndfile, libmpg123, and the LAME MP3 encoder. Those components remain under their own licences, which travel with the application and are included in the app bundle. Where such a licence grants you rights broader than these terms, that licence governs its component.
5. No warranty
Finito is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, title, or non-infringement.
I do not warrant that Finito will be uninterrupted, error-free, or free of defects, that it will run on any particular system, that its analysis or suggestions will be correct or suitable for your material, or that any result will meet a broadcast, streaming, or distribution specification.
Audio work is destructive if you let it be. Keep backups of your source files, and listen to every master before you release it. Finito writes exports only where you tell it to, but you are the last check on what leaves your studio.
6. Limitation of liability
To the fullest extent permitted by law, I am not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, nor for any loss of data, loss of audio, loss of profits, loss of revenue, or business interruption, arising out of or connected with your use of or inability to use Finito, on any theory of liability, even if advised of the possibility.
To the fullest extent permitted by law, my total aggregate liability arising out of or connected with Finito will not exceed the greater of the amount you paid for it, which is nothing, or 50 US dollars.
Nothing here excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow the exclusion of implied warranties or the limitation of incidental or consequential damages, so parts of sections 5 and 6 may not apply to you, and you may have other rights under your local law.
7. Updates
Finito checks for new versions and can install them with your consent. Updates are cryptographically signed and verified before installation. You can switch automatic checking off in the app's settings. Later versions are covered by these terms unless they ship with their own.
8. Availability and changes
Finito is offered as a free project and is developed as time allows. I may change it, add or withdraw features, or stop distributing it, at any time and without notice. The version already installed on your Mac keeps working under the licence in section 2 regardless.
I may update these terms. Material changes will be noted in the release notes, and the date below the title reflects the current version. Continuing to use Finito after a change means you accept it.
9. Termination
This licence ends automatically if you breach section 2. On termination, stop using Finito and delete it. Sections 3, 5, and 6 survive.
10. General
If any provision is held unenforceable, the rest stays in force and the provision is narrowed only as far as needed. My not enforcing a provision is not a waiver of it. These terms, with the privacy policy, are the entire agreement between us about Finito.
